The Protecting American Intellectual Property Act of 2022

by

The Protecting American Intellectual Property Act of 2022 provides some added deterrence against foreign (ex-US) entities and individuals to steal trade secrets from the US.  The Act requires the President to report to Congress annually on foreign entities who engage in trade secret theft that poses a threat to the US economy or national security.

The President is additionally required to sanction those entities and individuals.

It will be interesting to see how US victims of trade secret theft can include the foreign company or individuals on the list, and how the named foreign companies and individuals can defend against their inclusion.
